Being compensated the proper amount for any work which you perform is expected
as part of the job. Unfortunately, wage and hour laws are sometimes broken
by employers who wish to save money by failing to pay their employees
what is owed to them. When these issues occur, it is imperative to obtain
legal help from an experienced lawyer.
The Law Office of Thomas E. Rockett, III, we understand that you have a right to adequate compensation from your
employer. With more than 25 years of experience, our
Irvine employment lawyer can provide advice about your situation and your options for recovering
your entitled compensation.
Overtime & Unpaid Wage Violations
Employers sometimes ask employees to “work off the clock” to
get all of their work finished. If you are a nonexempt employee who works
more than eight hours or 40 hours per week, and your boss asks you to
work additional hours, then you may be eligible for overtime pay.
Nonexempt employees are also entitled to meal and rest periods throughout
the day. In California, those who work a five-hour shift should receive
an unpaid, off-duty meal period of at least 30 minutes. In addition, employers
need to provide a second meal break at least 30 minutes long for all workdays
on which an employee works over 10 hours, and must be provided no later
than the end of an employee’s 10th hour of work.
Remedies for wage and hour violations include:
- Unpaid wages
- Penalties for missed meal and rest break
- Waiting time penalties
