A whistleblower is an employee who identifies illegal activity in the workplace – cheating customers, forcing employees to work overtime for no pay, or ignoring health and safety codes. Unfortunately, those who try to do the right end up getting fired or experience some form of retaliation from their employer.

If you believe that you may have a whistleblower claim, our Irvine employment law attorney at The Law Offices of Thomas E. Rockett, III is ready to help you root out corruption by using the qui tam provisions of state laws and the federal False Claims Act. With over two decades of experience, we understand what it takes to obtain the compensation and justice you deserve.

California Whistleblower Law

The state law regarding whistleblower claims was strengthened in 2014, when three additional laws were enacted and added to the California Whistleblower Protection Act. The existing law already forbid employers to retaliate against an employee who reports violation of state or federal laws to a government official or law enforcement. One of the newer laws expands this to also include reporting a suspected violation internally or externally to “any public body” which conducts a hearing or investigation.

Furthermore, state law now extends liability beyond the employer to include anyone acting on behalf of the employer, such as third-party management. Anyone who is eligible for protection under these laws may also file a retaliation claim for any damages sustained.
